Terms and Conditions

1. These terms and conditions of business are between Mr A Johnson and Miss H Storr trading as Norfolk Nannies Agency (herein after called the 'Agency') and the employer client (hereinafter called the 'client') and are deemed to be accepted by the client by virtue of the completion of the employer’s registration form.

2. The Agency operates as an introduction agency between prospective employer’s and staff. The staff are not employed by the agency at any time, and all times are under the supervision, direction and control of the client.

3. The client agrees:

    a) to notify the agency immediately an engagement is agreed giving details of the date of commencement and the intended length.
    b) to pay the fee to the agency, within 14 days of the date of the invoice, this will be raised as soon as an agreement has been made.

4. The fee payable to the agency by the client for the employment of an applicant is calculated as set out in our scale of fees. Invoices must be paid within 14 days. A surcharge of 10% initially and a further 5% each subsequent month will be added to the owed amount if payment is not received within the timescale above.

5. Should the member of staff withdraw prior to commencement of employment, any fees will be rebated in full. Should the relevant employment be cancelled by the client prior to the commencement of employment, any fees will be rebated in full, less a service charge of £50 + VAT.

6. Should the employment terminate before the expiry of 4 weeks, the engagement fee will be rebated in full, and the client charged at the temporary rate, providing that the client notifies the agency in writing within 7 days of the termination of the employment, has paid the agency’s fee within 14 days of the date of the invoice, and has honoured the conditions of employment.

7. All information provided to clients is confidential. The passing on of an introduction to another employer, which results in an engagement, renders the client liable to payment of the agency’s fee. (paragraph 4).

8. The agency endeavours to ensure the suitability of any applicant introduced to the client. The client shall not with standing satisfy himself as to the suitability of any applicant. The client shall be responsible for obtaining work, and other permits, for the arrangement of medical examinations and\or investigations into the medical history of any applicant and satisfies any medical and other requirements or qualifications required by law.

9. The agency shall not be liable under any circumstances for any loss, damage or expenses suffered or incurred by the client arising from or in any way connected with the agency seeking an applicant for the client or the introduction by the agency to the client of any applicant or the engagement of any applicant by the client.

10. No variation can be made to these terms without the written consent of Mr A Johnson or Miss H Storr.
